Scope
These terms apply to the use of the Nightdeck app by buroLAB · Daniel Buro (Einzelunternehmen) (“we”).
What Nightdeck is
Nightdeck is a player. It contains no channels, movies, shows or playlists and does not arrange providers.
Only use Nightdeck with sources you're entitled to use, for example cable TV from your FRITZ!Box, your own media server or a licensed service. The respective provider is responsible for the content, availability and quality of the streams.
Free trial
For the first 3 days you can use Nightdeck free of charge and without restrictions. The trial ends by itself; it doesn't renew and never turns into a subscription. After that you need a license.
Purchase
You buy licenses through Gumroad. The seller and your contractual partner for the purchase is Gumroad, Inc. as merchant of record; Gumroad's terms apply to payment, invoice and sales tax. We grant you the right to use Nightdeck under these terms.
License
A license lets you use Nightdeck privately on up to 2 devices in your household.
Yearly license: it runs for one year and renews for another year each time unless you cancel. You can cancel at any time via the link in your purchase confirmation or in your Gumroad library; Nightdeck stays unlocked until the end of the paid year.
One-time purchase: you may use Nightdeck without time limit. We provide updates as far as they are necessary for Nightdeck to work as agreed; we may offer further improvements voluntarily.
Refunds
If you don't like Nightdeck after all, we refund the purchase price if you write to us at burolab.office@gmail.com within 14 days of the purchase – no reason needed. Statutory rights, such as a right of withdrawal, remain unaffected.
Not allowed
You may not circumvent the license check, share your license key with people outside your household, or use Nightdeck with sources you're not entitled to use. Rights under copyright law, such as §§ 69d and 69e UrhG, remain unaffected.
Warranty and liability
The statutory warranty rights apply.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee. For slight negligence we are only liable for breach of essential contractual obligations that make using Nightdeck possible in the first place and on which you may rely, and then limited to the typical, foreseeable damage. We are not responsible for the content, availability or quality of the sources you add.
Changes to these terms
We may change these terms for the future, for example when new features are added. Changes affecting an existing license only apply if you agree to them; Nightdeck will ask you.
Applicable law
German law applies. If you are a consumer with your habitual residence in another country, the mandatory consumer protection rules of that country remain applicable.
